Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.

This application under Section 482 Cr.P.C. has been filed for quashing the entire proceedings of Complaint Case No. 1280 of 2015 Smt. Kamlesh Vs. Sunil kumar and others under section 498-A,323,504,506,406,354,376 and 511 I.P.C. and section 3/4 of D.P. Act P.S. Mahila Thana Rakabganj district Agra pending in the court of A.C.J.M. court No. Xth Agra.

Upon considering various aspects of the case, it cannot be said that the summoning order 5.12.2015 passed by the court below is either perverse or illegal. It does not require any interference by this court. The impugned summoning order is sustained. The prayer made for quashing the same is without any substance. Specific allegation made against the applicant by O.P. No. 2. The charge is serious, therefore, it is provided that in case the applicant appear before the court concerned within two weeks from today and move application for bail, the same shall be considered and disposed of by the court below, expeditiously.

For a period of two weeks from today, no coercive action

shall be taken against the applicant.

It is made clear that in the event no such application is moved within the time prescribed above, this order will be of no avail to the applicants.

With the above direction, the instant application under Section 482 Cr.P.C. is finally disposed of.
