Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.

This application under Section 482 Cr.P.C. has been filed for quashing the N.B.W. dated 20.6.2018 passed by the Additional District and Sessions Judge Farrukhabad in Criminal Appeal No. 36 of 2016 (Sanjay Versus State of U.P. and others) in complaint case no. 1036 of 2007 under sections 498-A I.P.C. and section 3/4 of D.P. Act. P.S. Mohammadabad district Farrukhabad on the basis of compromise dated 25.5.2017.

Claim is that in this case some settlement has been arrived at between the parties and the matter was settled on the condition that a sum of Rs. 4 lacs shall be paid.

The applicant prays that during the process of payment some misunderstanding arose and the court below issued N.B.W. The applicant desires to pay balance/outstanding amount provided some time is given. The prayer has been made to the effect that N.B.W. dated 20.6.2018 be kept in abeyance. The amount of Rs. 1 lac has already been paid by the applicant to O.P. No.2.

The applicant is required to act in compliance of the settlement admitted to him and to make full payment for

which he has given three weeks time.

For a period of three weeks no coercive action shall be taken against the applicant provided he makes full payment of the balance amount. In case, he does not pay the full amount by 30th May, 2019 the court below will be duty bound to realize the same from the applicant within next 30 days.

With the above direction, the instant application under Section 482 Cr.P.C. is finally disposed of.
