Heard learned counsel for the petitioner.

The prayer in the present petition is to issue direction the court below to expedite the proceedings of Original Suit No.1394 of 2010 (Sharad Chandra Dwadash Shreni (since deceased) & Ors. v. Suresh Chandra Dwadash Shreni & Ors.).

From the order sheet, it is demonstrated by learned counsel for the petitioners that all the defendants have put in appearance in the said suit, however, they are not cooperating in the matter and trying to delay the disposal of the suit with required pace.

Having noticed the said fact, without expressing any opinion on the merits of the claim of the parties, the present petition is being disposed of with the direction to the court below namely the Additional Civil Judge, (Senior Division), Aligarh to decide the Original Suit No.1394 of 2010 (Sharad Chandra Dwadash Shreni (since deceased) & Ors. v. Suresh Chandra Dwadash Shreni & Ors.) expeditiously, preferably, within a period of one year from the date of submission of certified copy of this order, without granting any unnecessary adjournment to either of the parties.
