Sri Amar Nath Tiwari learned counsel for the applicant submits that the applicant has died resulting in abatement of the criminal proceeding against him.
In view of the above statement, the present application is dismissed as infructuous.
It is, however, open for the trial court to enquire so as to satisfy itself about the factum of death of the applicant.
