Learned counsel for the petitioner is permitted to implead the Principle Judge, Family Court, Allahabad as respondent no.2 during the course of the day.
Heard Sri Joveen Kumar, learned counsel for the petitioner and perused the record.
By the present petition under Art. 227 of the Constitution, the petitioner has prayed for a direction to Principle Judge, Family Court, Allahabad to decide Case No. 839 of 2018, (Amit Kumar Singh Vs. Shiv Shankar Singh) under Section 25 of the Guardians and Wards Act, 1984 within stipulated time.
It is contended by the counsel for petitioner that the application for appointment of the guardian of Saurya Singh minor was filed by the petitioner on 25.5.2018 which remain pending till date. It is further contended that service upon defendantrespondent was held to be sufficient vide order dated 18.9.2019 on the basis of publication through daily news paper and now the next date fixed is 8.1.2020.
Considering the facts and circumstances of the case, the Principle Judge, Family Court, Allahabad to decide Case No. 839 of 2018, (Amit Kumar Singh Vs. Shiv Shankar Singh) under Section 25 of the Guardians and Wards Act, 1984 as expeditiously as possible preferably within a period of six months from the date of the production of the certified copy of this order.
With the above direction, this petition under Art. 227 stands finally disposed of.
