The only prayer pressed by counsel for the petitioners is for issuing direction to the Appellate Court to decide application 5- Ga pending in Civil Appeal No. 62 of 2019. The appeal itself has been filed challenging the judgment dated 30th July, 2019 dismissing the suit for injunction filed by the petitioners. The Appellate Court has admitted the appeal by order dated 26.8.2019 and has invited objections on the application 5-Ga.
Counsel for the petitioners points out that application 5-Ga is still pending. He further points out that the opposite parties had entered appearance by filing caveat.
Accordingly, the instant petition is disposed of with direction to the Appellate Court to decide the apalication 5-Ga expeditiously, by fixing short dates and preferably within a period of four weeks from the date of receipt of certified copy of this order.
