Sri Ashish Kumar Srivastava, counsel for plaintiff-respondents points out that the suit itself has been decided finally by order dated 2.9.2019 in terms of a compromise. It is submitted that in such circumstances, the instant petition has been rendered infructuous.
It is noteworthy that the order impugned herein is the order passed by the trial court dated 2.3.2019 allowing amendment application filed by the plaintiff-respondents and thereby, deleting certain defendants from the array of parties. The petitioner was one amongst them. The revision filed by the petitioner also stands dismissed by order dated 31.7.2019.
Since the suit itself stands finally decided, therefore, in my opinion, the instant petition has been rendered infructuous. It is dismissed accordingly.
