Heard Sri Viveka Nand Rai, learned counsel for the petitioner.
By means of the present petition a direction is sought to the Civil Judge (Junior Division), Mathura to decide the S.C.C. Suit No. 23 of 2000 (Sri Lilanand Thakur vs. Ram Bharose) expeditiously which is said to be pending.
Counsel for the petitioner has referred to the order sheet of the case which has been filed along with this petition to submit that the case is at the stage of evidence and regular dates are being fixed but for some reason or other the case is being adjourned and the delay in disposal of the suit is causing undue hardship to the petitioner.
In view of the aforementioned facts and circumstances, the present petition is disposed of with an observation that in case the petitioner appears in the proceedings and does not seek any unnecessary adjournment it is expected that the court concerned would make an endeavour to decide the aforesaid case expeditiously in accordance with law provided there is no other legal impediment.
