By means of the present petition a direction is sought to the Judge Small Causes Court, Varanasi to decide the S.C.C. Suit No. 63 of 2012 (Kamta Prasad Agarwal vs. Bharat Lal and others) expeditiously.
Counsel for the petitioner has referred to the order sheet of the case which has been filed along with this petition to submit that the case is at the stage of argument and although several dates have been fixed but for some reason or other the case is being adjourned and the delay in disposal of the suit is causing undue hardship to the petitioner.
In view of the aforementioned facts and circumstances, the present petition is disposed of with an observation that in case the petitioner appears in the proceedings and does not seek any unnecessary adjournment it is expected that the court concerned would make an endeavour to decide the aforesaid case expeditiously in accordance with law provided there is no other legal impediment.
