Heard Sri Nitin Chandra Mishra, learned counsel for the petitioner and Sri P.K. Giri, learned Additional Chief Standing Counsel for the State-respondents.
This petition under Article 227 of the Constitution of India, has been filed praying for the following relief:-
"I. Call for record and direct the Court below to conclude the proceedings of Election Petition No.3 of 2017 (Ranjeet Singh vs. Dharmraj and others) pending in the court of Additional District Judge, Court No.1, Kushinagar at Padrauna within a span of time as fixed by this Hon'ble Court.
II. Pass such other and further order, which this Hon'ble Court may deem fit and proper in the facts and circumstances of the case.
III. Award costs."
On 30.05.2019, this court passed the following order:
"The instructions as have been received by learned Standing Counsel, be kept on record.
Today, learned Standing Counsel submitted that the hearing of the Election Petition had been completed and judgement was to be delivered.
Put up this case on 1st of July, 2019 so that the learned Standing Counsel may provide the progress of the case.
On the next date fixed learned Standing Counsel may get the progress of the case by FAX."
Today both the learned counsels for the parties jointly state that the Election Petition No.3 of 2017 (Ranjeet Singh vs. Dharmraj and others) has been decided by order dated 30.05.2019.
In view of the statement made by the learned counsels for the parties, this petition has become infructuous and is, therefore, dismissed.
