Heard Sri Krishna Dutt Tiwari, learned counsel for the petitioner.
The sole prayer of the petitioner is for a direction to the Additional District Judge, Court No.7, Moradabad to decide the J.S.C.C. Suit No. 15 of 2011 (Smt. Jinat Praveen vs. Masqoor Khan and others) within a stipulated period.
The counsel for the petitioner placing reliance upon the order sheet which has been filed along with the petition submits that the issues have already been framed by the court below and the case is at the stage of hearing and the delay in disposal of the suit is causing undue hardship to the petitioner.
In view of the aforementioned facts and circumstances, the present petition is disposed of with an observation that in case the petitioner appears before the court below and does not seek any unnecessary adjournment it is expected that the court below would make an endeavour to decide the aforesaid case expeditiously in accordance with law provided there is no other legal impediment.
