Heard Sri Ajay Kumar for the petitioner and Sri S.K. Mishra for the respondents-1 and 2.

The writ petition has been filed against the order of Estate Officer(respodent-2) dated 24.6.2017 passed in the proceeding under Public Premises (Eviction of Unauthorized Occupants) Act, 1971.

The dispute between the parties is in respect of the construction for installation of transformer of the petitioner of an area of 20.85 sq. metre on Survey Plot No.183/735, Meerut Cantt was directed to be removed. Earlier counsel for the petitioner was granted time to take instructions as to whether this construction has been raised after taking permission as required under Indian Telegraph Act, 1885 but the matter is old as such required instructions in this respect could not be obtained. Even under Section 10 of Indian Telegraph Act, 1885 permission for construction of installation of electricity equipment within limit of Cantonment Board by the Chief Executive Officer is necessary.

In the fact of the case the writ petition is disposed of giving liberty to the petitioner to file a proper application for permission before Chief Executive Officer, Cantonment Board for construction of room for the purposes of installation of transformer of electricity, within a period of two weeks and in case such application is filed by the petitioner a suitable order be passed on it within a period of two months thereafter in accordance with law.

The order dated 22.6.2017 shall be kept in abeyance till disposal of the application filed by the petitioner and it shall be abided by the final order passed by Chief Executive Officer.
