Heard Sri Hitesh Pachori for the petitione r and Standing Counsel for State of U.P., Sri Pankaj Srivastava for respondent-2 and Sri Abhay Dwivedi for respondents-3 and 4.

This writ petition has been filed for quashing the order dated 25.5.2017, rejecting the application of the petitioner for appointment in Dying in Harness Quota and for mandamus directing Executive Engineer (respondent-3) to appoint the petitioner under Dying in Harness Quota.

It may be mentioned that by the order dated 25.5.2017, Executive Engineer found that the application for appointment in Dying in Harness Quota has been moved on the basis of fabricated papers. Later on, an inquiry has been conducted under the order of Superintending Engineer and a report has been submitted on 9.8.2017, in which according to the petitioner, papers submitted by the petitioner were found as genuine, but no further order has been passed, in pursuance of the report dated 9.8.2017.

In the facts of the case, the writ petition is disposed of directing the Executive Engineer (respondent-3) to take a fresh decision in the matter relating to appointment of the petitioner in Dying in Harness Quota, in view of the report dated 9.8.2017, within two months from the date of producing a certified copy of this order before him.
