Heard learned counsel for the petitioners and learned Standing Counsel.

The petitioners are before this Court for a direction to second and third respondent to enter the name of the petitioners in Khatauni in Plot No.482 Arazi No.1020 Rakba 1-57 hect. situated in Mauja Jangal Dhusad, Tappa Khuthan, Pargana Haveli, Tehsil Sadar, Distt. Gorakhpur.

On the matter being taken up on 28.2.2018, the Court has proceeded to pass the following order:-

"As prayed, put up as fresh on 20.3.2018 in order to enable Shri Abhishek Shukla, the learned standing counsel to ensure compliance of the order dated 26.8.2000, under section 12 of U.P.C.H. Act, provided there is no legal impediment.

It is made clear that in the event the order is not complied with on or before the next date, the court may be constrained to pass a coercive order against the respondent in default. However, if the order is complied with, mere affidavit would suffice.

Copy of the order be provided to Shri Abhishek Shukla, the learned standing counsel forthwith."

Thereafter, the matter was taken up on 20.03.2018 and the Court has granted ten days time to learned Standing Counsel to comply the order dated 28.2.2018. On the matter being taken up today, in response to the order dated 28.02.2018 and 20.03.2018 passed by this Court, Shri Abhishek Shukla, learned Standing Counsel has placed the instructions dated 28.3.2018 sent by Tehsildar Sadar, Gorakhpur, wherein it has been intimated that the proceeding under Section 229-B of UPZA & LR Act is pending consideration and in the said proceeding the date is fixed as 18.04.2018.

Confronted with this, learned counsel for the petitioner states that direction may be issued to the authority concerned for finalisation of the aforesaid proceeding.

In the aforesaid facts and circumstances of the case, it is directed that the proceeding under Section 229-B of UPZA & LR Act be finalised at the earliest and thereafter the petitioner would be at liberty to move appropriate application under

Section 33/39 before the competent authority for redressal of his grievance.

The writ petition is disposed of accordingly.
