Heard learned counsel for the petitioner and learned Standing Counsel for the State respondent nos.1 to 4.

Notice need not be issued to the private respondent nos.5 to 9, in view of the order proposed to be passed.

The petitioner is before this Court with request to issue direction to the respondent nos. 2 to 4 to measure his plot i.e. Arazi No.384/12 area 0.114 hec. situated at village Rajapur Kalan, Tehsil Kasimabad, District Ghazipur and for direction to respondent no.2 to decide his application No.Nil of 2016 under Section 24 of U.P. Revenue Code, 2006.

Learned Standing Counsel fairly states that in case the aforesaid application is still pending and has not been disposed of, the same will be considered and decided expeditiously.

In view of the above, on consent and without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally with a direction to the second respondent, Deputy Collector, Tehsil Kasimabad, District Ghazipur to decide the aforesaid application after giving opportunity of hearing to the private respondent nos.5 to 9, as expeditiously as possible and preferably within a period of three months from the date of production of a certified copy of this order before him.
