Heard learned counsel for the parties.
By means of present writ petition, petitioner seeks following relief:
"(A) Issue a writ order or direction in the nature of mandamus directing the respondent No.2 & 3 to reinstate the fair-price shop licence of petitioner of Village Panchayat Madwa Hasanpur, Block Swar, Tehsil Tanda, District Rampur in the light of inquiry report dated 18.10.2017 as well as 26.12.2017 of respondent No.4 (Annexure No.5 & 7) within a specific span of time as to be fixed by this Hon'ble Court with immediate effect."
Without going into the merit of the case, the authorities shall consider the inquiry report dated 18.10.2017 as well as 26.12.2017, which are according to the petitioner in his favour.
If the authority concerned finds that requisite orders are required to be passed they shall pass an appropriate order in accordance with law on or before 12th October, 2018.
With these observations/directions, this petition stands partly allowed as another Bench of this Court on 22.3.2018 has passed an elaborate order.
