Heard learned counsel for the petitioner and learned Standing Counsel for the State.

The petitioner's grievance is multifold. He has been subjected to the cancellation of his fair price shop time and again. He has succeeded in appeals, he has succeeded before this Court despite that the officer concerned has been consistent in his endeavour to see that the petitioner's license does not meet the fate when this High Court might have thought that it should meet.

On being confronted by this Court on this issue, the learned Standing Counsel for the State conveys that a fresh order which would be reasoned order pursuant to the order of this Court, in letter and spirit, would be passed on or before 31.10.2018 and, therefore, this Court not to go into the merits of the litigation.

It is hoped that the authorities concerned will pass a fresh order in consonance with order of this Court passed in Writ Petition No.306 of 2011.

¶7

With these observations, this petition is partly allowed. Authorities concerned to pass the order on or before 31.10.2018.

¶8

However, in case of any difficulty, the petitioner is at liberty to move this Court for revival of this petition.
