Sri Ram Shish Ram, learned counsel appears for the petitioner, Sri Manoj Kumar Yadav, learned counsel appears for the respondent no.3 and learned Standing Counsel appears for the respondent nos. 1 and 2.

The petitioner in the writ petition is seeking quashing of the enquiry report dated 18.7.2018 with the further prayer to hold fresh enquiry in the matter relating to selection of ineligible persons for the Lohiya Awas.

According to the petitioner, she had applied for allotment of a house under the Lohiya Gramin Awas Yojana but the same has been allotted to the ineligible persons ignoring her claim. In this regard, it is stated that enquiry has also been held and a report was submitted on 18.7.2018 against which the petitioner has filed objection on 30.8.2018, which are still pending and no order has been passed. The learned counsel for the petitioner states that the petitioner would be satisfied if a direction is given to the District Magistrate to consider her objection dated 30.8.2018 to the enquiry report dated 18.7.2018.

We, therefore, dispose of this writ petition with a direction to the District Magistrate, Ghazipur, respondent no.2 to decide the objection of the petitioner dated 30.8.2018 to the enquiry report dated 18.7.2018 and pass an appropriate order in accordance with law within in a period of three months from the date of receipt of a certified copy of this order in his office.

It is made clear that the Court has not adjudicated the claim of the petitioner on merits.
