Heard Shri Gaurav Dwivedi, learned counsel for the petitioner and Shri Gaurav Singh, learned standing counsel for the State respondents.
Shri Gaurav Singh, learned standing counsel informs that payment of Rs. 10,54,277/- has been made to the petitioner and the amount has already been transferred to the account of the petitioner. This fact is not disputed by the petitioner but it is stated that the original amount was Rs.10,78,434/-. We, however find that the State G.S.T. and the Central G.S.T. has been deducted by the State which has to be paid by them for which necessary certificate shall be issued to the petitioner, which is also evidenced from the bills submitted by the petitioner on 21.2.2018, Annexure-5 to the writ petition. Therefore, after deducting the statutory deposit to be made, the entire remaining amount has been paid to the petitioner and therefore nothing further remains to be paid to the petitioner.
In this view of the matter, this writ petition is dismissed as having become infructuous.
