The case of the petitioner is that the State Government has framed a policy dated 1.06.2006 known as Special Economic Package which provides that on a capital investment of more than Rs. 100 crores, the new industries shall be given various benefits and acting upon this policy, the petitioner has also invested more than Rs. 269 crores and set up three units at Kinauni, District Meerut, Palia, District Lakhimpur Kheri and Kundrakhi, District Gonda. It is stated that subsequently by an order dated 3.08.2007, the policy dated 1.06.2006 was discontinued. The petitioner's contention is that taking advantage of the Special Economic Package Policy of 1.06.2006 it had made investment of Rs. 269 crores by setting up three units within the State of Uttar Pradesh and, therefore, he was entitled for the benefits contemplated in the Policy and after having lured him into setting up his units in U.P., the promises made in the said Policy could not have been revoked arbitrarily by the order dated 3.08.2007. His further submission is that in acknowledgement of the fact that the petitioner has made an investment of Rs. 269 crores in terms of the Special Economic Package Policy of 1.06.2006, Letter of Comfort dated 29.12.2008 was issued to the petitioner. He further submits that a High Power Committee met in this regard and in its minutes dated 4.4.2016, there is a mention under the column as to whether benefits have been given to Companies prior to the notification dated 3.08.2007 and with regard to the petitioner's Company at Sl. No. 10 and 11 it is mentioned as 'YES' which only goes to confirm that the petitioner has made his investment under the Policy of 2006 prior to the coming into force of the notification dated 3.08.2007.
