This writ petition has been filed by the petitioner, interalia, for the following relief:

"(A) Issue a writ, order or direction in the nature of mandamus commanding/directing the respondent no. 2 i.e. District Magistrate, District Bareilly to take the appropriate action in view of the application dated 11.09.2018 filed by the petitioner before him, as the petitioner requested therein to remove the old shabby construction of the petitioner, pursuant to notice dated 04.09.2018 as issued by respondent no. 5 after the proper enquiry, which is still pending before him for final disposal expeditiously within stipulated period."

Heard Sri Promod Kumar Srivastava, learned counsel for the petitioner, Sri Hemant Kumar, learned counsel appearing on behalf of the respondent nos. 5 & 6 and perused the record.

Learned counsel for the petitioner has stated that the order under Section 331(1) of the Uttar Pradesh Municipal Corporation Act, 1959 has already been passed by the Commissioner, Nagar Nigam, Bareilly for the demolition of the house in question, which is in a dilapidated condition and the petitioner is making all efforts to demolish the said house, but some local persons are causing hindrance and not allowing him to

demolish the said house, as such, it could not be demolished.

Considering the facts and circumstances of the case, it is provided that in case the petitioner approaches the Senior Superintendent of Police, Bareilly to ventilate his grievance, the Senior Superintendent of Police, Bareilly shall look into the matter personally and do the needful in accordance with law.

With the above observation, this writ petition is finally disposed of.
