The only grievance of the petitioner to have a direction for District Magistrate, Hamirpur to decide the representation dated 1st October, 2018, copy whereof is available on record as annexure 5.

As per the averments contained in the petition for writ, the respondent no.3 a contractor is constructing a road on the land owned by the petitioner. The illegal activity of the respondent no.3 as per learned counsel for the petitioner was brought to the notice of the Officers of the district administration including the District Magistrate, Hamirpur but of no consequence.

Having considered all facts of the case, we deem it appropriate to dispose of this petition for writ by keeping the petitioner at liberty to submit a fresh representation to the District Magistrate, Hamirpur for redressal of his grievance. The petitioner if submits such representation to the District Magistrate, Hamirpur within a period of three weeks from today, then the same shall be considered by the District Magistrate, Hamirpur in accordance with law within a period of four weeks subsequent thereto.

While considering the representation, if any, submitted by the petitioner, the District Magistrate, Hamirpur shall also provide an opportunity of hearing to the petitioner and other affected parties, if demanded.

With the directions as above, the writ petition stands disposed of.
