The issue raised in the present special appeals has already been answered by this Court in Special Appeal No. 666 of 2018 [Shikha Malviya and another Vs. State of U.P. and others] wherein the dictum laid by the learned Single Judge in bunch of writ petitions being leading one Writ-A No. 48664 of 2017 (Himanshu Shukla and another Vs. State of U.P. and three others) has been affirmed, in view of the order passed in the aforesaid special appeal, there is no reason or occasion for us to take a different or contrary view to the same.
In view of the above, present special appeals are also dismissed on the same terms and conditions as laid down by this Court in Special Appeal No. 666 of 2018 [Shikha Malviya and another Vs. State of U.P. and others].
