Sri Shashi Dhar Sahai learned counsel has put in appearance on behalf of respondent-bank.
Learned counsel for the respondent-bank has pointed out that the recovery was initiated against three sons (heirs of the loanee namely Shareef Ahmad). One of the sons had approached this Court challenging the recovery certificate dated 03.04.2018 wherein an order dated 13.04.2018 has been passed disposing of the writ petition with the observation that the entire amount is recoverable in the instalments as per the schedule fix therein.
A copy of the judgement and order dated 13.04.2018 has been placed before this Court.
This fact is not disputed by learned counsel for the petitioner. The present petition filed by another heir of the loanee challenging the same recovery certificate dated 03.04.2018, therefore, is not maintainable.
Dismissed as such.
