It transpires from the records of the writ petition is that the defendant No.3 in Original Suit No.2730 of 2017 filed by Ashok Kumar in the Court of Civil Judge (Junior Division). The writ petitioner has also filed an application under Order XXXIX Rule 2A of the Code of Civil Procedure 1908.
This petition has, however, been filed in regard to the same dispute raised the aforesaid original suit.
The Court, therefore, declines to entertain this petition. It is, accordingly, dismissed.
