The petitioner seeks the following relief :-
(i) Issue a writ, order or direction in the nature of mandamus directing to the respondent no. 2 to restore the supply of the petitioner forthwith in pursuance of the order dated 22.2.2018 passed by the learned commissioner.
On the basis of the instruction received, Sri Sanjay Ram Tripathi, learned Additional Chief Standing Counsel submits that pursuant to the order of remand passed by the appellate authority on 22.2.2018, a fresh inquiry was conducted. The aforesaid inquiry report submitted on 22.04.2018 by the District Supply Officer Rampur. The report indicts the petitioner on the charges of malpractices in distribution and recommends the cancellation of his license.
In the light of the aforesaid submissions, the instant writ petition has become infructuous.
The writ petition is dismissed.
