Heard learned counsel for the petitioners and Shri Abhishek Srivastava, learned Addl. Chief Standing Counsel for State respondents.
In view of the order proposed to be passed, notices need not go to private respondents.
The petitioners are before this Court for a direction to Sub Divisional Magistrate (SDM) and Tehsildar concerned to demarcate the land in question. It is also contended that regarding their grievances the petitioners had already moved representations on 13.12.2017, 8.1.2018 and 2.4.2018 and the same may be directed to be decided expeditiously.
Shri Abhishek Srivastava, learned Addl. Chief Standing Counsel raised an objection that U.P. Revenue Code, 2006 (in short "Code") is a self-contained Act and there is exhaustive procedure for the reliefs claimed by the petitioners and in case the petitioners move proper application as per the relevant provisions of Code, then definitely the authority concerned would proceed in accordance with law.
Confronted with this, learned counsel for the petitioners requested that liberty may be accorded to the petitioners to file such an application.
Considering the facts and circumstances of the case, the writ petition stands disposed of with observation that in case the petitioners move proper application as per the relevant provisions of the Code within two weeks before the SDM concerned, this Court hope and trust that the same would be considered and decided in accordance with law expeditiously but certainly after giving opportunity to the parties concerned.
