The sole relief pressed for by learned counsel for the petitioner at the time of hearing of this petition is that the application dated 17 July 2017 filed by the petitioner for refund of an amount of Rs.2,90,430/- in view of the order dated 3 March 2017 passed by the Commissioner, Aligarh Division, Aligarh in Appeal No.13/C-201118000075, be decided.
Sri Baleshwar Chaturvedi, learned counsel appearing for the respondents states that a decision shall be taken at an early date.
This writ petition is, accordingly, disposed of with a direction to the competent authority to take a decision on the application filed by the petitioner expeditiously and preferably within a period of two months from the date a certified copy of this order is filed by the petitioner.
It is made clear that the Court has not adjudicated on the merits of the case and it will be for the authority concerned to take a decision in accordance with law.
