The petitioner is aggrieved by the installation of a mobile tower by Jio Company. It is alleged that permission was not taken from the relevant authorities. For this reliance has been placed on the communications sent by the Officers of the Pollution Control Board, Ghaziabad Development Authority and the Nagar Palika Parishad, Loni, Ghaziabad.

The communication sent by the Executive Officer of the Nagar Palika Parishad, Loni, indicates that the District Magistrate is examining the matter. The petitioner has also filed a representation dated 22 February 2018 before the District Magistrate, Ghaziabad.

Learned Standing Counsel appearing for the State-respondents states that the District Magistrate, Ghaziabad shall take a decision at an early date. Dr. H.N. Tripathi, learned counsel appearing for the Pollution Control Board and Sri R.N. Upadhyay learned counsel appearing for the Ghaziabad Development Authority state that all necessary information shall be provided to the District Magistrate, Ghaziabad.

We, accordingly, dispose of this petition with a direction to the District Magistrate, Ghaziabad to take a decision on the representation filed by the petitioner after hearing the parties concerned including Jio Company which is said to have installed the Mobile Towers expeditiously and preferably within a period of two months from the date a certified copy of the order is filed by the petitioner.
