It transpires from the record that during the consolidation proceedings held in the Village under the U.P Consolidation of Holdings Act 1953 (hereinafter referred to as Act), the petitioner and respondent no. 3 filed objections under section 9-A of the Act claiming different shares in relation to plots in Khata Nos.283 and Khata No.7,78. On the said objections case nos.9 and 1237 were registered before the Consolidation Officer. The claim of the petitioner was that he and respondent no.3 have half share each in the said Khatas. The claim of the petitioner was on the basis of a partition decree passed by Judicial Officer, Mirzapur in Case No.136 of 1961 and the case of respondent no.3 was that after the death of Sankalia, he as the heir of Sankalia was entitled to 2/3rd share in the disputed Khata and the petitioner had merely 1/3rd share in the same. While the matter was pending before the concerned Consolidation Officer, the petitioner filed an application praying to amend his objection stating that before her death Sankalia had executed a Will bequeathing her share in favour of the petitioner and therefore, the petitioner prayed that he may be permitted to amend his objections in the light of the aforesaid Will.
