A perusal of the order dared 21.12.2017 as modified by order dated 18.1.2018 shows that under the Scheme to make the roads free from pits in distt. Panchayat Gorakhpur, the connecting roads were repaired in which its thickness was found less due to which it was held that an amount of Rs.97269/- in the work of Madhopur Harijan Basti, Rs. 1,23,797/- in the work of village Kunwarpur, Rs. 1,20,889/- in the work of SaraiyaJagdishpur to Dudhai connecting road, Rs. 1,06,583/- in the work of Ghghva Marhata P.M.J.S.Y to Barghat and Rs. 3,63,380/- in the work of Domar Ghat Shiv Temple to south have been embezzled. A copy of inspection report dated 4.10.2017 has been attached along with the writ petition which shows that while making inspection it was not taken into account as to earlier what was the crust thickness of the road. Thus, conclusion drawn from by the Inspecting Officer that thickness of the road was less than its earlier thickness does not appear to be a sound conclusion. In such circumstances the aforesaid amounts have already been withheld from the payment of the contractor.
