Heard Shri Vivek Kumar Singh, learned counsel for the petitioner; learned Additional Chief Standing Counsel for the first respondent as well as Shri A.K. Yadav for the second respondent.

Uttar Pradesh Prathmik Shiksha Mitra Association through its Secretary is before this Court with request to issue direction to the respondents to consider the claim for payment of Rs.38,000/- as monthly honorarium treating the Shiksha Mitra as Para Teachers as they have completed their BTC Course and in this regard, the budget was also allocated by the Government of India in its meeting dated 15.5.2017.

Learned counsel for the petitioner submits that in this regard the petitioner has already represented the matter before the first respondent on 25.2.2018. He has confined his prayer only to the relief that the petitioners' representation dated 25.2.2018 may be considered by the appropriate authority.

Learned Additional Chief Standing Counsel has no objection to the said prayer.

No useful purpose would be served in keeping the writ petition pending.

In view of above, without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally with a direction to the first respondent to decide the petitioner's representation in accordance with law within a period of two months from the date of production of a certified copy of this order before him.
