17. In the enquiry proceeding held on 12.08.2005 as earlier requested by the Charged Employee, he was this time represented by Sri R.K.Tiwari as Defence representative. The Presenting Officer produced attendance register, cheque book register, etc and, thus, the evidence of the presenting officer came to be closed. While two witnesses out of 7 persons ( supra ) Sri D.N. Khanna and S.P. Dayal were present, they were cross examined by the Defence Representative. On the question of further hearing in the matter, the Defence Representative took lame excuse of not being ready with the case as he wanted to peruse the records, so demanded 15 days more as reasonable time in the matter. The enquiry officer accordingly allowed them 15 days more time as a last opportunity and made it clear that in the absence of any of parties, enquiry proceeding will be held ex parte . Thus, the enquiry further proceeded as on the next scheduled date on 09.09.2005 but since Defence Representative had not prepared the defence documents to be submitted in defence of the Charged Employee and, therefore, he was requested to do the same and the Charged Employee submitted defence document stating further that he had no further documents to produce. He was also allowed to lead such defence witnesses, he wanted and further if any document was left to be produced he may do so also. However, Defence Representative stated that he had seen the documents of the presenting officer and examined the same and thus placed his defence.
