Heard learned counsel for petitioner and learned Standing Counsel for State respondents.

This Writ petition is directed against order of suspension dated 05.09.2014, which has been stayed by this Court vide order dated 19.09.2014. Petitioner had already received a charge sheet of which he has submitted reply too.

It is contended that after submitting reply to charge sheet, matter has not further proceeded and departmental inquiry is still pending. As such, order of suspension is also continue. It is stated that disciplinary inquiry in such a case cannot prolong by keeping petitioner under suspension. The authority concerned is under an obligation to complete inquiry within stipulated time. Three and half years have been expired but nothing further has been done in the matter.

In the above facts and circumstances, we direct the authority concerned to complete departmental inquiry within a period of three months from the date of production of certified copy of this order. In case, inquiry is not completed within three months as directed above, order of suspension shall automatically come to an end and stand quashed.

With the aforesaid direction, writ petition is disposed of.
