In compliance of the order of this Court, Smt. Shilpi Agarwal, Chairman, Nagar Panchayat, Jhunsi Allahabad has appeared before this Court. On querry being made as to why the post retirement dues of the deceased petitioner was not paid, she showed her ignorance on account of the fact that she was having charge of the post of Chairman only for last 4-5 months.
From the perusal of the record or the writ petition, it also transpires that no application/ representation has been made to the present Chairman. She has agreed that in the event any such representation is being made, she will pass appropriate order on the same within the period of six weeks from the date of such application being made to her.
In view of undertaking being recorded before this Court on account of personal appearance of 4th respondent, Smt. Shilpi Agarwal, Chairman, Nagar Panchayat, Jhunsi Allahabad, the present writ petition is disposed of with direction to the petitioner to make appropriate application/representation dealing all her grievance before the Chairman, Nagar Panchayat, Jhunsi, Allahabad within period of three weeks from today. In the event, any such representation/application is being made, the 4th respondent who is present in Court in person, shall examine the same and decide the same within further period of six weeks. Needless to say that opportunity of hearing shall also be given to the petitioner in this regard before final decision is taken.
