The petitioner had applied for enrolment as a Constable in the Central Reserve Police Force. His candidature was rejected. The petitioner was aggrieved by his non selection as a Constable in the Central Reserved Police Force. The petitioner approached this Court by instituting a writ petition. The writ petition was registered as Civil Misc. Writ Petition No. 6046 of 2006 (Mukesh Kumar Vs Deputy Inspector General and others). The writ petition was disposed of by judgment and order dated 01.02.2006. The operative portion of the judgment entered by this Court in the said writ petition is extracted here under:-
In compliance of the order passed by this Court the representation of the petitioner was considered and rejected by a reasoned speaking order dated 02.05.2006. The order dated 02.05.2006 rejecting the representation of the petitioner records that the petitioner was not found fit for appointment in the Central Reserve Police Force as he did not satisfy the minimum prescribed criteria for height. The height of the petitioner was found to be 169.05 cm. The minimum height requirement for the Force was 170.00 cm.
There is no perversity in the finding. The petitioner's candidature has been rejected for valid reasons as he admittedly did not satisfy the minimum physical requirement prescribed for appointment as a Constable in the Central Reserve Police Force.
The writ petition is dismissed.
