Heard Sri Ajeet Kumar Pathak, learned counsel for the petitioner, learned Standing Counsel for the respondent No.1 and Sri Abhay Kumar Patel holding brief of Sri Adarsh Bhushan, learned counsel for the respondents No.2, 3 and 4.

Learned counsel for the petitioner submits that the pensionary dues and other retiral benefits of the petitioner were not paid by the respondents in time. The petitioner is entitled to interest on the delayed payment of the aforesaid dues. The petitioner has made a representation in this regard.

Sri Abhay Kumar Patel, learned counsel holding brief of Sri Adarsh Bhushan, learned counsel for the respondents No.2, 3 and 4 submits that these facts have to be verified by the competent authority.

No useful purpose will be served by keeping the writ petition pending. By consent of the parties, the writ petition is being disposed of finally.

The matter is remanded back to the respondent no.4. A writ of mandamus is issued to the respondent No.4 commanding the authority to decide the claim of the petitioner for interest on delayed payment of his pensionary benefits and other retiral dues. The representation shall be decided by a reasoned and a speaking order within a period of four months from the date of receipt of a certified copy of this order along with a fresh copy of the representation.

The Court has not gone into the veracity of the assertions in the writ petition nor has the claim of the petitioner been judged on merits. It is for the competent authority to do so after independent application of mind.

With the aforesaid direction the writ petition is disposed of.
