Heard Sri Ashok Kumar Yadav, learned counsel for the petitioner, Sri Alok Kumar Srivastava, learned counsel for respondent no. 4 and learned Standing Counsel for the State respondents.
The father of the petitioner was employed as Safai Karmi in the Nagar Palika Parishad, Deoria. He died while still in service on 12.11.2017. The petitioner submitted an application for appointment on compassionate ground on 11.04.2018. This was followed up by a reminder application submitted on 10.09.2018. However, till date the case of the petitioner for appointment under compassionate ground has not been considered. The purpose of appointment on compassionate ground will be defeated in case of delay in considering the case of the petitioner for appointment under the dying in harness rules as applicable to the Nagar Palika Parishad, Deoria.
In such view of the matter the respondent no. 4 is directed to decide the application of the petitioner for appointment under dying in harness rules within a period of three months from the date of receipt of a certified copy of this order along with fresh copy of the representation.
The writ petition is disposed of finally.
