None appears to press the writ petition on behalf of the petitioner as well as respondents No.2 to 4, though the name of the counsel for the respondents No.2 to 4 is shown in the cause list. However, learned Standing Counsel for the respondent No.1-State is present.
On 28.8.2018 when the matter was taken up for hearing in the revised call, learned counsel for the respondents No.2 to 4 was not present. Learned Standing Counsel defended the case of the State. On 28.8.2018, this Court passed the following orders:
"List has been revised.
None appears to press the writ petition on behalf of the petitioner as well as respondent Nos.2, 3 and 4. However, learned Standing Counsel is present.
Office is directed to inform the learned counsel for the respondents No.2, 3 and 4 to appear in the Court. Learned counsel for the Secretary, Basic Shiksha Parishad, Allahabad to be present when the matter is taken up for hearing in the next cause list. In case learned counsel for the respondents No.2, 3 and 4 is not present, the Court may consider summoning the respondent No.2 to assist the Court.
List in the next cause list. "
Today, when the matter is taken up, learned counsel for the respondents No.2 to 4 is not present. In a number of cases, the counsel for the Basic Shiksha Adhikari is not appearing to defend the case. Consequently, learned Standing Counsel is requested to assist court.
In the light of the above, the interim order passed
by this Court is operative till date. The interim order is made absolute.
The writ petition is disposed of in terms of the interim order.
After the order has been dictated and the hearing of the other matters in the list was mid-way, Sri R.P. Shukla, learned counsel has appeared and submits that he intends to appear as counsel for the B.S.A., Bhadohi. However, this does not obviate the larger problem of the regular absence of counsel for the B.S.A. when the matters are taken up.
Sri R.P. Shukla, learned counsel submits that he was not a counsel in the year 2007. He does not have any information to this matter as well and his records are not complete.
These are administrative issue. The court is not concerned with the same. The respondent no.1 shall look into the matter and take appropriate measures.
A copy of this order may be communicated to the respondent No.1-Secretary Basic Education, Lucknow.
