Heard learned counsel for the petitioner and the learned Standing Counsel for the State respondents.
This petition calls in question the validity of an order of suspension dated 14 May 2018. From a bare perusal of the recitals contained therein it prima facie appears that the petitioner has been caught on video demanding and accepting a bribe of Rs.8,000/-. Bearing in mind the seriousness of the charge which stands levelled, the Court finds no ground warranting interference with the order of suspension.
Learned counsel has additionally contended that in respect of the same incident an F.I.R. was also lodged which was assailed before this Court in a writ petition, in which protection has been granted to the extent that the petitioner shall not be arrested till submission of a charge sheet. The Court finds no ground to entertain this petition or to interfere with the order of suspension on this score since mere pendency of the investigation in respect of a criminal charge cannot detract from the power and jurisdiction vesting in the competent authority to initiate disciplinary action against the petitioner.
The petition consequently stands dismissed.
