Heard Sri Vidhu Prakash Pandey, learned counsel for the petitioner, learned standing counsel for the State-respondents and Sri Rakesh Kumar Pandey, learned counsel for respondent No.1.

This writ petition has been filed praying for the following relief:

"(i) Issue a writ, order or direction in the nature of Mandamus commanding/ directing the respondent No.2 and 3 not to implement the decision of 51st meeting of Executive Committee of Education Project Board dated 21.12.2017 regarding Additional Agenda No.3 which is contrary to the approval accorded by Project Approval Board, Ministry of Human Resource and Development, Government of India and ensure compliance of the recommendations and approvals for session 2017-2018 by the Project Approval Board, Ministry of Human Resources Development, Government of India."

The petitioner is part-time instructor under Sarva Shiksha Abhiyan. His grievance is that honorarium at the rate of Rs.17,000/- per month was approved by Central Government as proposed by the State Government but honorarium of Rs.9800/- only has been fixed by the Executive Committee of Education Project Board in its 51st meeting dated 21.12.2017, which is contrary to the approval of Project Approval Board, Ministry of Human Resources Development, Government of India.

Considering the facts and circumstances of the case, the grievance of the petitioner needs to be examined at first instance by the respondent No.2. Therefore, this writ petition is disposed of giving liberty to the petitioner to make a representation before the respondent No.2 within three weeks from today alongwith a certified copy of this order. In the event such a representation is made, respondent No.2 shall decide it in accordance with law, expeditiously, preferably within next three months, after affording reasonable opportunity of hearing to the petitioner.
