Present petition has been filed with a prayer to direct the respondents to remove illegal encroachments made by illegal occupants over Pokhar Gata Nos. 332 and 418 and further direct the respondent nos. 3 to 5 to demarcate the land of way situated over pokhar gata nos. 332 and 418 and to restore it on its original number.
From perusal of the record, it appears that the land does not belong to Gaon Sabha and as such, this Court would not have jurisdiction to entertain the present petition.
At this stage, learned counsel for the petitioner prays that he may be permitted to withdraw the present petition with liberty to avail remedy as may be available in law.
Present petition is accordingly dismissed as withdrawn with liberty aforesaid.
