Pursuant to the order dated 25.10.2018 learned Standing Counsel has produced a copy of the instruction alongwith three coloured photographs signed by one Girish, who is stated to be Tehsildar, which indicates that the encroachment has been removed.
In such view of the matter, no cause survives.
Present petition is accordingly dismissed.
At this stage, learned counsel for the petitioner sought time to reply the same, therefore, it is provided that in case the facts as stated are incorrect, the petitioner is at liberty to file application for recall of this order alongwith coloured photographs with a caution that in case the contents of the affidavit, if any filed by the petitioner in support of the recall application, are found incorrect, heavy cost may be imposed on the petitioner.
