Order on Delay Condonation Application

This appeal is barred by limitation from 25 days.

Having considered the facts stated in the application seeking condonation of delay, we are satisfied that he was prevented from filing the appeal for a bonafide reason.

The delay in filing the appeal, thus, is condoned.

This appeal is before us to examine the correctness of the judgement and order dated 24.05.2018 passed by learned Single Bench in Writ-A no.11562 of 2018 keeping the order dated 28.04.2018 in abeyance. By the order aforesaid respondent-employee was placed under suspension.

Learned counsel appearing on behalf of the appellant states that the interim order passed by learned Single Bench virtually amounts to acceptance of the writ petition at the admission stage.

Having considered the arguments advanced and also facts of the case, we deem it appropriate to dispose of this appeal by requesting learned Single Bench to consider and decide the petition for writ expeditiously as far as possible within a period of one month from today.

It is made clear that disposal of appeal as well as pendency of writ petition in no manner shall restrain the authority competent to pass appropriate order in accordance with law as per the order dated 17.05.2018 passed in Writ Petition no.11949 of 2018.
