Short counter affidavit has been filed on behalf of respondent no. 5 and 6 today is taken on record.

Heard Sri Amit Daga, learned counsel for the petitioner, Sri Sudhir Kumar Agarwal, learned counsel for the respondent no. 5 and Sri Vikas Sahai, learned A.G.A. for the State.

The corpus Nahima @ Naeema has been produced before this Court by the police custody on enquiry, the corpus states that she want to go with Murtaza with whom she wants to live. As per under Section 164 Cr.P.C. statement of the corpus, it is apparent that it is not a case of taking or enticing away and from relationship one child was born out is with corpus in Nari Niketan and Murtaza who has filed the present petition and also present in the Court and has been identified by Sri Amit Daga, learned counsel for the petitioner.

As the notice to respondent no. 4 has not been served therefore, we direct the Superintendent of Police, Muzaffarnagar, to release the corpus with child to go with Murtaza with undertaking given by learned counsel for the petitioner no. 2 Murtaza that he shall produce the corpus alongwith child on the next date. The corpus be taken back to Nari Niketan from where she shall be released along with child to go with petitioner no. 2.

List this matter again on 14.03.2018.

On that date Murtaza shall produce along with corpus Nahima @ Naeema and her child before this Court.
