Heard Sri Virendra Kumar Jaiswal, learned counsel for the petitioner and Sri Vikas Sahai, learned A.G.A. for the State.

This writ petition has been filed by the petitioner with the prayer to quash the F.I.R. dated 30.11.2017 which has been registered as Case Crime No. 678 of 2017, under Section 306 I.P.C., P.S. Khoda, District Ghaziabad.

Learned A.G.A. pointed out that the case has been converted under Section 305 I.P.C. in place of Section 306 I.P.C. on the basis of the age of the deceased. It is further submitted that Suicide note of the deceased recovery from the place of occurrence has been quoted in para 3 of compliance. He further stated that general behaviour of the teacher was good which was also stated by students and the principal and its form to good.

Learned counsel for the petitioner states that the petitioner being a teacher of the deceased and she has not acted in manner which may provoke the deceased to commit suicide.

From the perusal of the interim order dated 06.02.2018 passed by this Court it appears that this Court had stayed the arrest of the petitioners till submission of police report under Section 173 (2) Cr.P.C. and since the investigation has not been completed till date , we dispose of this writ petition with the direction that the petitioner shall not be arrested till submission of police report under Section 173 (2) Cr.P.C.

The petitioner shall file a certified copy of this order within two weeks' from today before the

S.S.P. concerned, who shall look into the matter and ensure that the investigation in the above mentioned case is completed expeditiously preferably within six weeks from the date of production of certified copy of this order.

With the aforesaid direction, this petition is finally disposed of.

Learned A.G.A. shall communicate this order to the concerned authorities concerned.
