The case of revisionists is that daughter of revisionist no.1 was married with opposite party no.2 according to muslim rituals and they were living as husband and wife. Due to mental and physical torture by opposite party no.2 husband, her daughter has left her matrimonial house and started living with her father. It is also mentioned that opposite party no.2 got married with someone else. Daughter of revisionist no.1 filed a suit of maintenance under Section 125 Cr.P.C. on 4.5.1992 in the court of Judicial Magistrate, Durg (M.P.), which was decreed in favour of daughter of revisionist no.1 on 30.3.1993 and awarded a maintenance of Rs.400/- per month. Opposite party no.2 had also filed a suit for restitution of conjugal rights on 18.7.1992, which was dismissed by learned Munsif Magistrate, Banda on 4.11.1993. This was the reason that present complaint has been filed.
