Heard learned counsel for the applicant and learned AGA for the State, and perused the record.
According to prosecution case, FIR was lodged against Neeraj, Ashok, Mukesh, Ram Kumar and Roop alleging that on 22.2.2018 they assaulted Pramod Tyagi. He received several injuries and resultantly died.
It is submitted by learned counsel for the applicant that deceased died due to only one injury received on head. General role was allegedly assigned to all the accused. The applicant has been falsely implicated in the present case. It is further submitted that the co-accused Ram Kumar has already been enlarged on bail by this Court on 10.10.2018 in Criminal Misc. Bail Application No.38916 of 2018. He is languishing in jail since 25.02.2018 and having no criminal history. There is no independent witness. In case applicant is released on bail, he will not misuse the liberty of bail and will cooperate in the trial.
Learned A.G.A. has opposed the prayer for bail, but could not dispute the aforesaid facts.
