2-According to report dated 17.9.2018 of C.J.M., Bareilly, the appellant Gajju Singh @ Gajraj has been died. In this regard, the statements of S.I. Saroj Singh, Gram Pradhan Dinesh Kumar Singh, the son of deceased Balveer Singh and other persons have been recorded. Hence the appellant has been died and the appeal filed by him is abated.
3-The appeal is dismissed as abated.
4-It is also pertinent to mention here that appellant was convicted under Section 304 I.P.C. and sentenced to undergo ten years rigorous imprisonment.
