This Criminal appeal has been preferred by Shobh Nath against judgment and order dated 22.1.2010 passed by Additional Sessions Judge/FTC.III, Jaunpur in Session Trial No. 385/2008 convicting and sentencing appellant Shobh Nath for five years rigorous imprisonment under section 436 IPC with fine of Rs.2500/- and in default of payment of fine, six months additional imprisonment.
According to report of CJM, Jaunpur dated 21.4.2018, appellant Shobh Nath has died. Death certificate issued by Pradhan, Gram Panchayat Kabirpur and statement of S.I. Sarvejeet Yadav and Dinesh Kumar Pal have been annexed with the report.
No purpose would be served in keeping this appeal pending. The appeal is dismissed as abated.
